Terms of Service
Version 1.1 · Effective 2026-10-28
Draft pending legal review. Not approved by a lawyer.
1. Acceptance of these Terms
These Terms of Service ("Terms") form an agreement between you and WageMetria, operated by Steven Watson, Sole Proprietor, of British Columbia, Canada ("WageMetria", "we", "us"). By creating an account or using WageMetria you agree to these Terms, our Privacy Policy and our Subscriptions, Cancellation & Refunds Policy. You accept these Terms by ticking the acceptance box when you create an account. If you do not agree, do not use WageMetria.
Nothing in these Terms removes or limits any right you have under consumer protection or privacy laws that cannot be waived by contract, including the British Columbia Business Practices and Consumer Protection Act. If any part of these Terms conflicts with such a law, the law prevails.
2. What WageMetria is
WageMetria is a digital tool for tracking work hours and estimating employment earnings. Features currently available include: tracking work hours, shifts and rotations; calculating regular earnings; calculating overtime and double time based on the rules you select or configure; tracking shift premiums, living-out allowances and other pay items; estimating vacation pay and statutory holiday pay based on your settings; tracking more than one job; keeping a history of your calculations; year-to-date earnings summaries and exports; and comparing expected gross earnings against figures you enter from your own pay statement.
Estimates of income tax, CPP and EI deductions and of net pay are not currently offered to users. We will only describe a feature as available once it is working in the application.
3. Estimates only — not payroll, legal or financial advice
WageMetria provides estimates and informational calculations. WageMetria is not your employer, a payroll processor, a law firm, an accounting firm or a government authority, and is not certified by the Canada Revenue Agency.
Results depend on the information you enter, your employer’s policies, any collective agreement, applicable legislation and other circumstances we may not know about. Results are not a guarantee of what you will be paid and are not a legal determination of your entitlements. A difference between a WageMetria estimate and your pay statement does not by itself prove that your employer made an error or breached employment standards law. Verify important results against your official employment records and, where appropriate, with your employer, union, the applicable employment standards office or a qualified professional.
4. Your responsibilities
You agree to: keep your login credentials confidential and tell us promptly at support@wagemetria.ca if you believe your account has been accessed without permission; provide information that is accurate to the best of your knowledge; use WageMetria only for lawful purposes and only for your own employment information or information you are authorised to use; not attempt to access other users’ accounts or data, interfere with the service, reverse engineer it except as permitted by law, or use automated means to extract data; and not present WageMetria reports as official payroll records or as statements made by WageMetria about any employer.
5. Your information
You keep your rights in the employment information you enter. You allow us to store and process it only to provide WageMetria to you and as described in our Privacy Policy. We do not sell your employment information and we do not send it to your employer.
6. Our intellectual property
The WageMetria software, name, logo, design, calculation logic, text and other materials belong to WageMetria or its licensors and are protected by law. We give you a personal, non-transferable, revocable licence to use WageMetria for your own purposes in accordance with these Terms.
7. Availability, changes and rule updates
We work to keep WageMetria available, but it may occasionally be unavailable because of maintenance, updates, outages of our service providers or events outside our control. We may improve or change features and update calculation rules as laws and our research change. If we make a change that materially reduces a paid feature during a period you have already paid for, we will tell you in advance and you may cancel and receive a refund for the unused portion as described in our billing policy.
We may update these Terms. We will post the new version with a new version number and effective date and, for material changes, notify you by email or in the app before they take effect. Changes do not apply retroactively.
8. Liability
To the extent permitted by law, WageMetria is provided on an "as available" basis, and we are not responsible for decisions you make based on estimates, or for indirect or consequential losses. To the extent permitted by law, our total liability to you for any claim relating to WageMetria is limited to the greater of the amount you paid us in the twelve months before the claim and [pending Canadian legal review: this draft cap does not override any consumer protection legislation that applies to you] CAD $50.
These limits do not apply where the law does not allow them, including liability for our own fraud, gross negligence or wilful misconduct, or any guarantee, warranty or right you have under consumer protection law that cannot be excluded. Nothing in these Terms requires you to use private arbitration, waives your right to take part in a class proceeding, or restricts you from posting honest reviews.
9. Suspension, cancellation and termination
You may stop using WageMetria and request deletion of your account at any time (see /delete-account). You may cancel a paid plan at any time as described in our Subscriptions, Cancellation & Refunds Policy, without cancellation fees.
We may suspend or close an account that seriously or repeatedly breaches these Terms, puts other users or the service at risk, or where required by law. Where reasonable, we will give notice and an opportunity to respond first. If we close your account without cause during a paid period, we will refund the unused portion.
10. Governing law and contact
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If you live elsewhere in Canada, you also keep the protections of the mandatory consumer laws of your province or territory, and you may bring a claim in the courts or tribunals available to you there.
